Barbantio is saying that he would rather adopt a child then have a half black grandchild.The jealousy causes Barbantio to become racist, ending their relationship. Therefore, jealousy can cause people in a Family(In Law) relationship to act with evil, resulting in the downfall of the family relationship. Jealousy can cause spouses to act evil and irrational, ensuring the downfall of the marriage. Husbands go from trusting their wives to distrusting their wives for the reason that jealousy causes them to, hence ending their marriage. Othello declared, â€Å"My life upon her faith! † in a response to Barbantio uttering, â€Å"She has deceived her father, and may thee. (Act1 scene 3 line 293), this shows that he is fully trusting of Desdemona in the beginning of their marriage. Then Othello becomes jealous of Cassio because he believes that Cassio is sleepingwith Desdemona, this jealousy initiates Othello’s distrust in Desdemona. This distrust towards Desdemona results in Othello not believing Desdemona when she says that she is a â€Å"true/ and loyal wife† (Act 4 scene 2 line 34-5) results in the end of the relationship because Othello slays her because he suspects that she is cheating.Furthermore, jealousy can cause a member of the relationship to act illogically resulting in the collapse of the relationship. Othello started out as a very sensible person who would always think of a logical solution. This shows that he was in a logical state of mind before the jealousy caused him to become unreasonable.He became so unreasonable that he started seeing what the jealousy inside of him wanted to see. The jealousy caused him to be unreasonable to the point where a simple hanker chief, that Desdemona could have easily lost, triggered him into thinking that Desdemona and Cassio are having an affair, which led to him plotting to kill both of them. Additionally, Othello and Desdemona’s have a very pleasant marriage, until abuse starts because of jealousy. Answer: Introduction: Consideration is the value that a party gets in a formal contract in exchange of some promise or value. No contract without consideration can be enforceable by law. It is necessary that consideration cannot be based on past performance. Consideration should be the valid as per the law. Therefore, consideration refers to exchange of some promise or value by the parties. Issue Analysis - Jane has Lotus Super 7 sports car. She is going to overseas and due to that reason she offers her car to jack. It is also given that the market value of the car is $25000. Jack accepts this offer. Rules- As per the language of law, consideration stands for exchange of promise or products having some worth. Consideration can be one thing, which is received by one party in exchange of some promise or valuable. From point of view of Jack, there is nothing performed or promised by Jack, so car cannot be stated as consideration for Jack. In this offer, there is no disclosure of the money or price, on which Jane offers her car to jack. Only the market price of product is given in the case. Jack accepts this offer. It cannot be considered that Jane has offered her car for purpose of sell. It is possible that Jane had offered the car is gift. Issue Shipbuilders build a contract with North Ocean Tankers to build a tanker. This contract is done in US dollar but at the time of contract, they do not mention any information about currency fluctuations in future. But when the United States devaluated dollar by 10 percent then shipbuilder asked that buyer pays extra US$ 3 million, if it was not done, then it would stop the construction of tanker midway only. In this situation, the buyer had to pay extra amount because North Ocean Tankers already booked a charter for the delivering the tanker. But after the nine months of delivery, buyer didnt take any action to recover the excess payment. Now, buyer wants to take action against the excess payment. This issue is to be analysed whether at this time North Ocean Tankers will be successful or not in recovering the excess payment. Rules of Law: In this case below law is identified, which can be applied: Duress: Duress is a condition in, which the individual is threatened to enter into a contract. In the current time, Duress includes the violence and illegal threats but courts have the different economic duress to increase the validity of claim. When an individual enters into this type of contract then it has the power to terminate contract. Along with this, the basis of duress includes the free consent and it operates based on the common law. Apart from this, undue influence is also a contract or condition, which affects the mutual consent of the contractors. This condition helps the individual in taking the advantage of trust during a contract (Wild et al 2014). Furthermore, it includes the situation where one party has the better position over the another party. This contract and condition doesnt involve the duresss threats but at same time it involves the uncontrolled pressure of the party. Duress to the person: Duress of the person can be expressed by the threat of violence. In this type contract, a person or individual comes by the fear of threat of physical violence. This type situation has the needs to prove that pressure was the reason and what was the cause behind entering into contract (Mann and Roberts, 2011). If the individual is not able to prove the reason then the contract can set aside by the court on the basis of threats. Duress to goods: The threat of damage or crush the property may duress. Along with this, threat to seize and detain the goods through the wrongfully is also called the duress. Apart from this, when a person or individual enters into contract through the pressure and pay extra money for the recovering the goods in terms of avoid the seizer and damage of goods (Trevino and Nelson, 2010). This pressure of shipbuilder forced the North Ocean Tankers to enter into a contract, which is illegal. Conclusion: Shipbuilder company made a contract with the North Ocean Tankers. After the half construction of tanker shipbuilder told to North Ocean Tankers that they pay an additional sum of US$3 million to meet the losses from the devaluation of currency by 10 per cent by the United States if it will not done then the construction of the tanker will be stopped at the mid. If the contract is cancelled by the client because tanker is not ready it would affect the reputation of company and this can might the reason of heavy claims. Moreover, this increases the cost of the North Ocean Tankers because they additionally make a contract with a charter company for the delivery. On the basis of above discussion, it can be concluded that North Ocean Tankers made an additional payment to shipbuilder under the duress so, now North Ocean Tankers is the able to recover its excess payment after the nine months as per the provisions of the contract law. Remedies The major issue in this case is that the shipbuilder puts the pressure on the North ocean tanker and threatens them that they pay the amount i.e. $3million and if not then they breach the contract midway and stop further work. North ocean tankers had already entered into a contract with a charter company for the delivery of tanker. Therefore, at this time they pay the extra amount to the shipbuilder to avoid the loss of business and reputation. After the nine months, North ocean tanker can go to the court for indemnify loss because North ocean tankers made the payment to shipbuilder in the duress and due to intimidation. In this case, North ocean tankers can be successful in the recovery of excess payment. For this particular case, evidences can be collected from the Kolmar Group AG Vs Traxpo Enterprises Pvt Ltd. Case. In this case, the contract was done for the supply of methanol, but Traxpo refused the supply of goods on the predetermined price and offer to Kolmar Group that if company wants to take the supply of methanol for this company, then they should pay extra price. Therefore, company accepts the new prices if it is not done as the company stopped the supply of methanol (Andrews, 2015). At this time, Kolmar Group have the requirement of the supply of methanol so, under pressure Kolmar Group accepts the contract in terms of new higher price. After sometimes, this case was taken to the court and it was held by court that Kolmar Group made promise of the paying the higher price under the duress and tort of intimidation. NSW has 760,000 students and 2200 public schools making it the State with the highest student and public schools population in Australia (NSW Department of Education and Training, 2003). An average of 350 students would be served in each institute if the number of students was evenly spread out across the available schools. If each teacher was is responsible for a maximum of 30 students, less than 20 teachers would be required for each institution. Combined with administrative and non-administrative staff, the number of non-student population would be between 30 and 40 adults. Regulatory agents would be tasked with supervising and interviewing this non-student population in schools . Recently, Self-Regional researched and gathered specific fall data that included â€Å"mobility/gait, lower-extremity strength, history in fractures, visual, or auditory impairments, dizziness, dehydration, depression, stroke, ischemic attacks, and cardiac arrhythmias† and the role they play with patient falls in the organization (The Joint Commission, 2007, p. 26). They are now in the process of researching various methodologies to help manage and improve this area of concern.Several concepts that concern total quality management (TQM), and quality improvement (QI) are offering health care organizations and their administrators the opportunity to decide which methodology would be most successful in improving quality care for their patients. There are three methodologies Self-Regional is considering: 1) Six Sigma, 2) Lean, and 3) Customer Inspired Quality (CIQ). â€Å"One of the key components of quality improvement is the technology that gathers and compares the data that the quality improvement measure produces† (Dlugacz, 2006).Once this information has been gathered, the organization can benchmark with other comparable organizations. The Six Sigma model, pioneered by Motorola, is used to improve the quality of process outputs by identifying, and removing defects through a problem-solving approach that works to improve quality outputs. The Six Sigma methodology achieves this by using a process known as the DMAIC process (define, measure, analyze, improve, and control), for existing quality processes that are below specifications, and are in need of improvement in increments.There are features with Six Sigma that separates it from other initiatives of quality improvement: * Clear focus on achieving measurable and quantifiable financial returns * Increased emphasis on stron g leadership and support * Special Infrastructure of â€Å"Champions,† to lead and implement the Six Sigma approach * Clear commitment to making decisions based on verifiable data, rather than assuming or guess work (Harry, 2000). The second model is Lean, which played a key role for Toyota’s success.This method is used to help reduce or alleviate waste, while working to improve an organization’s performance through their workflow processes. Organization’s that use Lean have a clear understanding of consumer value, and continuously will focus on the key processes to improve it. Information Technologies for Quality Improvements Information technology plays a major role when it comes to quality improvement methods used by health care organizations.Self-Regional Hospital has implemented software known as Business Objects. The components of Business Objects â€Å"provide performance management, planni ng, reporting, query and analysis, and enterprise information management† (Sap. com, 2008). The Business Objects Enterprise offers the organization the ability to track report instances by triggering alerts. The reports have parameters that can be modified to perform analysis on the data and the organization also has the ability set alerts that trigger when certain conditions are met or not met.The data can be customized to show in charts and can be customized to allow the organization the opportunity to drill down into the data. Information technology allows data to also be displayed in a dashboard or a scorecard. A dashboard is a tool that monitors the ongoing performance of a process and its data in real time. Whereas, scorecards report on past performances and generally focuses on outcomes rather than processes. All of these applications can be used by administrators to track quality improvement processes of the organization.Administrators also have the ability to design t he scorecards or dashboards to display only information that is pertinent to the process. Its always hard to write things on leadership as you always keep thinking what would happen if people hate what you write? Could my article discourage them? Or can they misinterpret my ideas and use them to manipulate others? I know this will happen. But there will also be a great number of people who will be asking the question, trying to change something in their lives. This is what keeps me going. Effective Leadership Skills This is a touchy subject for me as we may spend hours arguing about what leader should look like but will never find the solution as it depends on the team, field, purpose, type of work involved, and so much more. Learning for leadership very often involves things like public speaking, project management, and critical thinking. But I would be lying if I didnt mention two qualities which I believe play the most crucial role and are important for almost any sphere or field: empathy and love for learning. Learning is about finding something great about everything you deal with finding something important about it. So I would say that the love of learning incorporates next things:meaning and purpose of learning. There is nothing bad about professional growth, but successful leader understands that studying across different fields brings the perspective and helps find a creative approach towards the most complex and complicated problems. Most people learn when they are forced to, meaning when they have to get the degree or want to earn promotion. A smart leader understands the need for life-long learning and can acquire skills before they actually need them. A key to effective leadership is the ability to is to inspire others to learn. Can that be developed or it is a natural feature? I sincerely believe that almost every trait humans have can be taught or trained, so the question remains: how to inspire the love for learning in people?Encourage personal interest: the better we relate to the certain subject, the easier it will be to find any sort of interest in it. Ask questions and let people ask questions by creating a safe environment and making sure people can open up. Inspire the growth of the mindset. Human Resource Management:- HRM is concerned with carrying out the same functional activities conventionally performed by the personnel function such as HR Planning, Job analysis, recruitment and selection, employee relations, performance management, employee appraisals, compensation management, training and development but it performs these functions in a qualitatively distinct way as compared with personnel management. History of Human Resource Management:-   The concept and name of human resource management has been changed many times throughout the history. The changes were mostly because to the change in social and economic activities throughout the history. Human resource management came to birth when industrial revolution took place in the year 1833 then the industrialist incepted to increase their production and they raised the burden of work on the employees by having 60 hours a week. The workers became fed up of this circumstance and they took decision among themselves to find out the solution for this problem. After this workers were losing interest in their work and they divided in different groups and all this caused less production. The industrialists came to know this, they straggle to satisfy the workers but however the workers were not happy with that and formed their Trade Union. Now the industrialists gave full authority to one manager. In spite of this the problems remained constant because the manager was not able to ha ndle their problems then the workers went to strike for their rights.  Ã‚  This led to the formation of personnel management. Personal management was working only when clashes arise. PM was dealing on bargaining, so this system also failed to motivate the employees, in addition PM was not able to take full control of it. The combination of wartime production demands, government wage price controls and the need to negotiate cooperative agreements forced many companies to expand their personnel staffs and control their HR practices. Such basic HR practices as job classification systems, hiring standards, uniform pay grades and written disciplinary procedures were developed for the first time by many companies.    Another early donor to HRM was called the human relations movement. Two researchers, Elton Mayo and Fritz Roethlisberger included human factors into work. This movement began as a result of a chain of studies conducted at the Hawthorne facility of Western Electric in Chicago between 1924 and 1933. The purpose of the study was to conclude the effects of illumination on workers and their output. The studies pointed out the significance of the social interaction and work group on output and satisfaction. There are some but it can be better by little effort. RECOMMENDATIONS Following are some recommendations based upon our analysis. We observed that employees are not aware of their depth policies o the employee are lacking in the knowledge about policies which is the responsibility of HR manager to aware them. MOBILINK HR should have to monitoring and measuring employee s performance. HR lacks in terms of career planning and development so MOBILINK has to recognize this function in their policy statement. MOBILINK should have to increase in its recruitment sources so that they will not loose the potential candidates. HR manager should have to make clear communication with their lower staff which in terms makes the organization beneficial.
